This legislation revises the vacant and foreclosed property law enacted in 2012 by removing the limitation that only properties that have received a land use disturbance permit can be included on the foreclosed real property registry.  It also clarifies that certain foreclosed properties are not subject to registration if the deed is filed with the clerk of superior court within 60 days of the foreclosure sale or transfer of the deed in lieu of foreclosure.

This bill repeals Code Sections 32-9-13 & 32-9-14 relating to restrictions on use of MARTA proceeds. It becomes effective only if a companion bill reconstituting the MARTA board is enacted at the 2013 session.

This legislation mandates that a local jurisdiction's water rate charged to a multi-family dwelling served by a master meter be no more than the water rate charged to a single family dwelling. ACCG is working with the Georgia Association of Water Professionals to understand the impact of this bill, any rate differentials, and will be commenting to the General Assembly.

This bill allows "failure to wear a seat belt" to be admissible as evidence in civil actions for the purpose of mitigating damages.  Georgia counties are often defendants in cases involving motor vehicle accidents where the plaintiffs argue that an accident was caused in an alleged defect in a county road.  This bill simply allows counties, as defendants, to introduce evidence that if a front seat passenger, aged 14 years or older, had been wearing a seat belt as required by law, he or she may have suffered less extensive injuries.  If a jury finds that the failure to wear a seat belt contributed to the occupant's injuries, the jury would be required to reduce the occupant's recover to the extent that the injuries were caused by failure to wear the seat belt.
